Terms and Conditions of Sale
1. PURPOSE OF THIS DOCUMENT
These general terms and conditions of sale (hereinafter referred to as the "General Conditions") govern the sale of clothing and accessories from the Trussardi collection (the "Products") to end consumers (the "Customers" or the "Customer") by Trussardi Milano S.p.A. or another company belonging to the same group (the "Seller") through the relevant section of the website https://www.trussardi.com (the "Website"), in accordance with the procedures described therein.
Sales of Products between the Seller and the Customers are governed by these General Conditions.
Products may be marketed and shipped only to the countries indicated in the section of the Website where the Customer can select the shipping country. For the purpose of these General Conditions, “end consumer” means any natural person acting for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out.
The Products are marketed by Trussardi Milano S.p.A., with registered office at Via Santa Barbara n. 11 – Alba (CN), Italy, registered with the Chamber of Commerce of Cuneo, tax code and VAT number 04101240044, or by another company of the same group.
For any information relating to these General Conditions or to purchases made under them, Customers may fill in the support request form in the “Contacts” section of the Website (Online Customer Service).
2. FORMATION OF THE CONTRACT
The information and details provided on the Website do not constitute public offers, but merely an invitation to submit purchase proposals.
A purchase proposal is submitted by the Customer when the electronic order form is completed and confirmed on the order summary screen.
Customers may place an order either as a Registered User (logging into their reserved area) or as a Guest, by simply providing a valid email address to which the order confirmation and related updates will be sent. If a Guest order is placed using an email already associated with a registered profile, the system will automatically assign the order to that existing profile.
If the Customer wishes to receive an invoice, they must request it from Online Customer Service.
During checkout, registered Customers may indicate a shipping address different from the one saved in their profile.
Once the order form has been sent, the Customer will see a summary page and receive an email confirming receipt of the order.
By sending the order form, the Customer agrees that any purchase contract will be governed by these General Conditions. All orders are subject to the Seller’s acceptance, who reserves the right to refuse any order proposal at their sole discretion, particularly in the following cases:

the data provided by the Customer is incomplete or incorrect;

the Customer cannot be classified as an end consumer or does not meet payment requirements;

the ordered Products are unavailable. In this case, the Seller will not be held responsible for availability changes. If only some of the ordered Products are unavailable and no other reason exists to reject the proposal, the Seller will proceed with the available Products.
In such cases, the Seller will inform the Customer by email that the order (in whole or in part) has not been accepted, and therefore, the contract has not been concluded. Any amount already paid by the Customer will be refunded. If pre-authorization was granted, the Seller will release the funds.
The purchase contract is concluded only when the order is accepted by the Seller, who will send an order processing confirmation to the Customer’s email.
3. PRICES AND PAYMENT METHODS
3.1. Product prices, shipping costs, and payment methods are those shown on the Website and are expressed in euros. Product prices include VAT but exclude shipping costs, which are added to the total. The Seller reserves the right to change prices at any time and shall not be held liable for any price variation.
3.2. The Customer agrees to pay for the Products using the following methods:

Credit card (online): Visa, Mastercard, Maestro. Payments are managed through secure servers by Banca Sella using SSL 128-bit encryption and VeriSign certification. The Seller does not access the card data. A pre-authorization will be carried out to ensure sufficient funds. The charge is made only after contract confirmation.

PayPal: charged upon confirmation of order receipt. If the order is not accepted, the amount will be refunded.

Klarna: allows split payment in 3 interest-free installments charged to the Customer’s card: first upon shipment, then after 30 and 60 days. Klarna’s terms are available at www.klarna.com. The Seller is not responsible for Klarna’s acceptance or any disputes.

Cash on Delivery: payment in cash upon delivery to the courier. No change is given. Maximum order amount: €499.
4. PRODUCT SHIPPING METHODS
4.1. Products will be delivered according to the timeframes and methods indicated for the delivery service selected by the Customer on the Website. Shipping costs are borne by the Customer and vary depending on the chosen service. After shipping, the Seller will send a confirmation email with tracking instructions.
4.2. Product risk transfers to the Customer upon delivery to them or a designated third party. If the Customer selects the courier (and not one offered by the Seller), risk transfers upon handover to that courier.
5. RIGHT OF WITHDRAWAL
5.1. The Customer has the right to withdraw from the contract without penalty and without giving any reason, within 14 calendar days from receipt of the Products.
5.2. The withdrawal must be exercised using the return procedure indicated on the Website.
5.3. The Seller provides a return process in the "Request a return" section of the Website.
5.4. Returned Products must be intact: not used, worn, washed, or damaged. All tags and labels must still be attached.
5.5. Products must be returned within 14 days from when the Customer initiated the return. More information is available in the “Returns and Refunds” and “FAQs” sections of the Website.
5.6. Refunds are processed according to Section 6, using the same payment method as the original order.
6. REFUND TIMEFRAMES AND METHODS
6.1. If the withdrawal is valid and the returned Products pass inspection, the Seller will notify the Customer via email of the acceptance.
6.2. If all items are returned, the Seller refunds their cost (net of any discounts) and any shipping charges paid by the Customer. In case of partial return, only the returned items are refunded. Refunds are issued within 14 days of notification of withdrawal, after verifying all conditions are met. The Seller may withhold the refund until the Products are received or the Customer provides proof of shipment.
6.3. If the payer differs from the recipient, the refund will be issued to the payer. In case of cash on delivery, the Customer must provide the IBAN for refund by bank transfer.
7. PRODUCTS
7.1. Products shown on the Website are original “Trussardi” branded items. Product descriptions are available on each product page. Actual colors may vary due to browser or screen settings.
7.2. All Products are covered by the legal warranty of conformity under Articles 128–135 of the Italian Consumer Code. This warranty protects against faulty or non-conforming goods.
7.3. Defects present at delivery may be reported through the return process, as long as the 14-day deadline (see 5.1) is still valid.
7.4. The Seller will inspect the returned Product (with original labels) and notify the Customer of acceptance or rejection.
7.5. In case of a confirmed defect, the Customer has the right to choose between repair or replacement, free of charge, unless the remedy is impossible or disproportionately costly. In such cases, the Customer is entitled to a price reduction or refund.
8. PERSONAL DATA PROTECTION
For all matters concerning personal data processing and its purposes, please refer to the privacy policy available on the Website.
9. APPLICABLE LAW AND DISPUTE RESOLUTION
These General Conditions are governed by Italian law, including the Consumer Code and relevant provisions on distance contracts, as amended by Legislative Decree 21 February 2014 n. 21 and Legislative Decree 9 April 2003 n. 70 on electronic commerce.
Jurisdiction for any dispute regarding the validity, interpretation, or execution of these General Conditions lies with the court of the Customer’s place of residence or domicile.
The Customer may also resort, free of charge, to a recognized national or EU alternative dispute resolution (ADR) body.
Italian residents may refer to the list of national ADR bodies at the “Controversie di consumo” link.
EU residents are advised to consult consumer dispute resolution services available in their country or via the EU Commission’s site: “Consumer complaints in the EU.”
